Bankruptcy
Our
firm represents individuals and commercial clients (debtors
and creditors) in bankruptcy proceedings, at both the state
(Assignments For the Benefit of Creditors) and federal level.
The insolvency matters are initiated by either an insolvent
individual, or business, or creditors seeking to have the debtor's
remaining assets distributed among the creditors and, thereby,
discharging the debtor from further obligation or restructuring
and reorganizing the insolvent's debt structure. Our attorneys
pursue commercial and personal collection matters, including
obtaining Bankruptcy Court relief from the automatic stay to
permit secured lenders repossession of collateral and enforcing
foreign and out of state judgments against debtors throughout
New Jersey and New York City.
Commercial Transactions & Consumer Law
We
provide a wide variety of services to our business clients from
assisting in selecting the type of organizational entity under

are well versed in Unfair/Deceptive business practices matters.
We pursue and defend a full range of consumer complaints against
banks, real estate brokers, and other businesses. We also provide
our clients with credit review and repair services.

Litigation includes all matters of dispute in the court systems
and within the various systems of alternative dispute resolution
which are not allegations of criminal conduct. We feel that
we can provide you with quality representation in a variety
of civil litigation fields. Where a matter calls for technical
knowledge that our firm does not currently have, we are happy
to associate attorneys and other personnel with the appropriate
qualifications.
We
have a broad litigation practice that focuses on delivering
results for our clients. Our firm represents and advises clients
who are or might become involved in a lawsuit or appeal as a
result of a dispute, including prevention and settlement, in
such areas as employment claims, contract disputes, and commercial
matters. Our attorneys also pursue and defend a range of commercial
litigation and contract disputes including business and real
estate purchase/sale agreements, vendor/customer agreements,
noncompete, non solicitation, and nondisclosure agreements for
employers and employees. Matters handled by the firm include
bankruptcy preference and fraudulent conveyance actions, insurance
defense, commercial contract litigation, immigration litigation,
and policy setting challenges to state laws and regulations
affecting our clients. If it's related to business or commercial
law, please contact us and we will discuss with you how we can
handle your case.
Immigration
The
U.S. Bureau of Citizenship and Immigration Services ("BCIS"
- formerly "INS") is one of the most confusing and
complicated agencies of the U.S. government. It is critical
for foreigners to seek competent attorney representation when
dealing with BCIS. BCIS's current rules and regulations are
very confusing and many of those rules change with very
little notice to the public.
Many clients are worried about attorney’s costs or BCIS fees.
Because of this, many will either decide not to file an application/petition
or decide to file their paperwork without the aid of an attorney.
Be aware that if you choose to file your paperwork without an
attorney there is no one to help you. You may be unfamiliar
with your application/petition and may not fill it out correctly
or you may not file it properly. This can result in your application/petition
being delayed or rejected. Moreover, if you file on your own,
you will always worry whether you completed it correctly or
if you should have filed a different form.
Be aware that BCIS rules change often and with little or no
notice to the public! Hiring the Law Offices of Jae Y. Kim,
LLC will increase your chances of a successful application/petition.
We will keep you informed about the status of your case by phone
or by e-mail throughout the entire process.
We handle all types of immigration cases. Here is some information
regarding some of our services:
